We adhere to the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, which ensure your rights as a customer are protected.

This policy outlines how we handle refunds, returns, exchanges, and warranty claims for both online purchases and workshop services.

1. General Overview

We take great care in the quality of our products and workmanship.
If something isn’t right, please contact us as soon as possible so we can make it right.

2. Your Rights Under New Zealand Law

Under the Consumer Guarantees Act 1993 (CGA), you are entitled to a repair, replacement, or refund if a product or service is faulty, not fit for purpose, or does not match its description.

This policy does not limit or replace your rights under the CGA — rather, it explains how we apply those rights in practice.

3. Returns for Online Purchases

3.1 Eligibility for Return

To be eligible for a return, your item must:

  • Be unused, uninstalled, and in its original condition
  • Include all original packaging, labels, and documentation
  • Be returned within 14 days of purchase or delivery

Please note:

  • We do not accept returns for change of mind unless at our discretion
  • Special-order, electrical, or custom-made items are non-returnable unless faulty

3.2 Return Process

  1. Contact us via email or phone to request a return authorisation
  2. We’ll provide instructions and a return authorisation number (RMA)
  3. Package the product securely and include proof of purchase
  4. Ship to our address (return postage is the customer’s responsibility unless the item is faulty)

Once received and inspected, we’ll notify you of the outcome and process a refund, replacement, or repair as applicable.

3.3 Return Shipping

You are responsible for return shipping costs unless:

  • The item is faulty, damaged on arrival, or incorrect
  • The return was due to an error on our part

If eligible, we’ll cover or reimburse reasonable shipping costs.

4. Faulty, Damaged, or Incorrect Items

If your item arrives faulty, damaged, or incorrect, please contact us within 7 days of receiving it.
We may request photos or inspection before approving a replacement or refund.

Once verified, we’ll:

  • Replace the item at no charge, or
  • Provide a full refund (including shipping), or
  • Offer a repair or store credit, depending on your preference and product availability

5. Warranty Claims

Most parts and components sold by Darkart Motosport come with manufacturer warranties.
Warranty coverage applies to defects in materials or workmanship — not wear, misuse, racing damage, or improper installation.

To make a warranty claim, please provide:

  • Proof of purchase
  • Details of the fault or issue
  • Photos or inspection availability

We’ll liaise with the manufacturer or distributor to resolve your claim as quickly as possible.

6. Refunds

If approved, refunds are processed to the original payment method used.
Please allow 5–10 business days for funds to appear, depending on your payment provider.

Refunds will not be provided for:

  • Normal wear and tear
  • Damage from incorrect installation, modification, or misuse
  • Track or race use unless explicitly covered by product warranty

7. Workshop & Service Refunds

We stand by the quality of our servicing and tuning work.

If you’re not satisfied with a service, please contact us within 7 days of collection so we can inspect and address the issue.

Refunds for services are assessed case by case and may include:

  • Free rework or adjustment
  • Partial refund (if appropriate)
  • Full refund only if the service was not carried out as agreed or under the Consumer Guarantees Act

Please note: we cannot refund for performance outcomes influenced by factors outside our control (e.g. rider skill, track conditions, or aftermarket parts fitted elsewhere).

8. Special Orders & Custom Work

Special-order, race-use, or custom-made parts cannot be refunded or exchanged unless defective.
This includes:

  • Custom-built suspension components
  • Track setups and modified parts
  • Software or ECU tuning services

If an issue arises, we’ll work with you to rectify it under warranty or service guarantee terms.

9. Race & Track Use Disclaimer

Performance parts and tuning services are often designed for race or off-road use only.
It is your responsibility to ensure modifications comply with New Zealand road regulations.
Darkart Motosport is not liable for any damage, injury, or legal consequences resulting from improper or unauthorised use.
