2. Online Store & Product Sales
2.1 Prices and Payment
All prices are shown in New Zealand Dollars (NZD) and include GST unless otherwise stated.
Payment must be made in full at the time of purchase via the available payment options (e.g. credit/debit card, bank transfer, or other secure gateway).
2.2 Product Availability
While we aim to keep stock information up to date, occasionally items may be unavailable or on back-order. If a product you have ordered is out of stock, we will contact you to arrange a refund, replacement, or alternative product.
2.3 Shipping and Delivery
We ship within New Zealand using trusted courier services. Delivery times are estimates only and may vary depending on location and product availability.
We are not liable for delays caused by postal or courier companies.
2.4 Risk and Title
Ownership of goods passes to you once full payment has been received. Risk in goods passes upon delivery.
2.5 Returns and Refunds
We comply with the Consumer Guarantees Act 1993.
If a product is faulty, damaged, or incorrectly supplied, please contact us within 7 days of receiving it.
Returns are accepted only with prior authorisation and in original condition unless the item is faulty.
Change-of-mind returns may incur a restocking fee or may not be accepted.
2.6 Warranties
All products are covered by manufacturer warranties (where applicable).
Installation or modification of parts outside of professional guidance may void warranty coverage.
3. Workshop Services
3.1 Bookings and Estimates
Bookings can be made online, by phone, or in person. Estimates are provided in good faith but may change upon inspection of your motorcycle.
3.2 Payment Terms
Workshop services must be paid in full upon completion unless otherwise agreed. Parts ordered specifically for your job may require a deposit.
3.3 Vehicle Storage and Collection
Completed bikes must be collected within 5 business days of notification unless prior arrangements are made. Storage fees may apply after this period.
3.4 Warranty on Workmanship
We stand by our workmanship. If a service-related issue arises within a reasonable period, contact us immediately. This warranty does not cover wear-and-tear, misuse, racing damage, or modifications made after service.
4. Race and Track Use Disclaimer
Many performance parts and setups are intended for off-road or race use only.
It is your responsibility to ensure that any modifications comply with New Zealand road laws and certification requirements (e.g. LVVTA).
Darkart Motosport is not liable for any loss, damage, or injury resulting from use of parts or tuning outside intended purposes.
5. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential loss (including loss of income or data).
- Our total liability for any claim shall not exceed the amount paid for the product or service in question.
- Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
6. Intellectual Property
All content on this website, including images, text, graphics, and logos, is the property of Darkart Motosport or its suppliers and is protected under copyright law.
You may not reproduce or distribute any content without prior written consent.
